Mark Cuban believes President Joe Biden should use Donald Trump's own words against him regarding his viability on statewide ballots in 2024 and why he shouldn't again step foot into the White House.

The business magnate referenced Trump recently being removed from presidential primary ballots in Colorado and Maine, the former of which was decided in a 4-3 decision saying that the former president violated the 14th Amendment by engaging in an insurrection.

The decision followed a lawsuit filed by six Colorado voters to bar Trump from the state's presidential ballot and came one month after a lower Colorado court ruled that Trump engaged in an insurrection based on his actions on January 6, 2021.

Maine Secretary of State Shenna Bellows, a Democrat, followed with the same decision and reasoning last Thursday, fending off calls for her own impeachment by saying she was "doing her job and following the law in Maine."

The Trump campaign has ridiculed these decisions and is planning to appeal.

"I wish Biden would come out and say he wants Trump on the ballot. The 14th doesn't apply. Then thanks him for the playbook describing how to never leave office and the appreciation of knowing he can't be charged, no matter what he does," Cuban wrote Sunday on X, formerly Twitter.

Cuban added: "And ends it with 'My Fellow Americans, I'm not ever going to leave the White House and there is nothing you can do to me.' Which would confirm exactly why SCOTUS will keep Trump off the ballots and why Trump will never get immunity."

Newsweek reached out to Cuban via email for comment.

Biden commented on the Colorado decision, telling the press that courts would determine whether the 14th Amendment applies or not to Trump's situation.

"I think it's self-evident...[Trump] certainly supported an insurrection," said Biden, who often shies away from commenting on Trump's various legal cases. "There's no question about it. None. Zero. And he seems to be doubling down on it, about everything."

Biden, who is facing an impeachment inquiry at the hands of House Republicans, has plenty of ground to make up in his own right this year. The Democrat has had an average approval rating below 50 percent for more than two years, with disenchantment expressed toward his handling of the economy, immigration and foreign policy.

In November, it was announced that Cuban would be selling his majority stake in the Dallas Mavericks to Miriam Adelson, owner of the luxury resort company Las Vegas Sands who was married to billionaire Sheldon Adelson from 1991 until his death in 2021.

He also said he would be leaving the popular ABC show Shark Tank this year after his 16th season, prompting more questions of whether he would run for political office.
